These Terms and Conditions (“Terms”) form a legally binding contract between you and IQ Artist Management Ltd (“IQ”, “we”, “us”, or “our”). By accessing or using iqmgmnt.com (the “Site”) you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the Site.

Company & Regulatory Information

Display of these particulars satisfies Regulation 6 of the Electronic Commerce (EC Directive) Regulations 2002.

1. Definitions

Content” means all text, graphics, audio, video, data, code and other material on the Site.
Services” means artist-management advice, career resources, events, downloadable tools, newsletters and any other offerings delivered via the Site.
You / your” means the visitor or user of the Site.

2. Acceptance of Terms

2.1 We use a click-wrap banner (“By continuing, you accept our Terms”) to obtain explicit consent, ensuring enforceability under UK case-law favouring click-wrap over browse-wrap.
2.2 If you are under 18, you must obtain a parent or guardian’s permission before using the Site.

3. Intellectual Property

3.1 Except where stated otherwise, all Content is owned by IQ or its licensors and is protected by UK copyright law.
3.2 You are granted a personal, non-exclusive, non-transferable, revocable licence to view the Site for non-commercial purposes only.
3.3 Reproduction, redistribution, public display, or commercial exploitation requires prior written consent.

4. Permitted Use

4.1 You agree not to:

  • reproduce or scrape Content;
  • attempt unauthorised access to servers;
  • introduce viruses or malicious code;
  • harvest emails for marketing.

4.2 Breaches may lead to civil action and/or criminal prosecution under the Computer Misuse Act 1990.

5. Reliance on Information & Advice Disclaimer

5.1 The Site provides general music-industry information only. It is not financial, legal, immigration or tax advice.
5.2 Professional advice should be obtained before acting on any Content.
5.3 We endeavour to ensure accuracy but make no warranties that Content is error-free.

6. Artist Materials & Third-Party Content

6.1 Artwork, audio and video relating to represented artists are published under licence. Rights remain with the original right-holders.
6.2 Third-party embedded content (e.g., YouTube videos) may set its own cookies; see Section 14.

7. User-Generated Content

7.1 If you submit comments or materials:

  • you grant IQ a worldwide, royalty-free, perpetual licence to use, display and distribute the submission;
  • you warrant you own or control all necessary rights;
  • you must not post defamatory, obscene or infringing material.
    7.2 We reserve the right to remove content in breach of these Terms without notice.

8. Account Registration & Security

8.1 Certain tools or downloads require registration. You must:

  • provide accurate information;
  • keep passwords confidential;
  • notify us of unauthorised use.
    8.2 We may suspend or terminate accounts for violations.

9. Newsletter & Email Marketing

9.1 Subscription uses a double-opt-in mechanism to meet UK GDPR standards.
9.2 Tracking pixels or first-party attribution cookies deployed via FluentCRM operate only after consent is given through our Cookie Banner (see Section 14).
9.3 You may unsubscribe at any time via the link provided in each campaign email.

10. Events, Masterclasses & Ticketing

10.1 Separate event-specific terms may apply. If absent, the following default conditions govern bookings:

  • Full refunds for cancellations requested within 14 days of purchase (Consumer Contracts Regulations 2013).
  • Event rescheduling: tickets remain valid; refunds offered if new date unsuitable.
    10.2 Nothing in these Terms affects statutory rights under the Consumer Rights Act 2015.

11.1 Outbound links are provided for convenience. We do not endorse and are not responsible for third-party websites or their content.
11.2 Third-party sites are subject to their own terms and privacy practices.

12. Limitation of Liability

12.1 Nothing excludes liability for death or personal injury caused by negligence or for fraud.
12.2 Subject to 12.1, IQ’s total aggregate liability arising out of or in connection with your use of the Site shall not exceed £100.
12.3 We are not liable for:

  • indirect or consequential loss;
  • loss of data, profits, goodwill or opportunity;
  • errors or omissions in Content;
  • technical interruptions beyond our control.

13. Indemnity

You agree to indemnify and hold IQ, its directors, employees and agents harmless from any claim or demand (including legal fees) arising out of your breach of these Terms or infringement of any law or third-party rights.

15. Consumer Rights Notice

15.1 If you are a consumer, the Consumer Rights Act 2015 guarantees that digital content we supply will be of satisfactory quality and fit for purpose.
15.2 If the Services breach statutory rights you may be entitled to a repair, replacement, or refund.

16. Termination

IQ may suspend or terminate your access immediately if you violate these Terms. Obligations that by nature survive termination (e.g., intellectual-property provisions, limitation of liability) shall continue in force.

17. Variations to These Terms

We may update these Terms from time to time. Material changes will be notified via the Site banner or email at least 30 days before they take effect. Your continued use after changes constitute acceptance.

18. Severability

If any provision is found unlawful, void or unenforceable, that provision shall be deemed severed and shall not affect the validity of the remaining provisions.

19. Governing Law & Jurisdiction

These Terms and any dispute arising from them are governed by the laws of England & Wales; the courts of England & Wales have exclusive jurisdiction.
